Booking Terms and Conditions

This form is designed such that in the arise of an event, suitable measures can be taken, thus indemnifying Sailboarding Safaris, or any person, agent, unpaid assistant, or employee helping or anyone under the employ of Sailboarding Safaris during the extent of the Safari.

In consideration of Sailboarding Safaris accepting this application, and permitting myself to attend a Sailboarding Safari, I agree to this release of Claims, waiver of liability and assumption of risk (collectively, this agreement). The Trade Practices Act, 1974 and the Victorian Goods Act, implies into contracts for the supply of goods and services certain non-excluding conditions and warranties. Except to the extent that I have non-excludable rights under those Acts, I waive any and all claims I may now and in the future have against, and release from all liability and agree not to sue Sailboarding Safaris and its officers, Employees, Instructors, Agents or Representatives (collectively its staff) for any personal injury, death, property damage or loss sustained by me as a result of my participation in this activity due to any cause whatsoever, including without any limitation of negligence on the part of Sailboarding Safaris and its officers, Employees, Instructors, agents or Representatives (collectively its staff).

I am aware that this activity, in addition to the usual inherent dangers and risks, has certain additional dangers and risks, some of which include: physical exertion for which I am not prepared, and evacuation difficulties if I am disabled.

I accept all the inherent risks of the proposed activity and the possibility of personal injury, death, property damage or loss resulting therefrom.

I acknowledge that the enjoyment and excitement of Sailboarding Safaris is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or at work and that these inherent risks contribute to such enjoyment and excitement being a reason for my participation. I agree that if I suffer injury or illness, Sailboarding Safaris can at my cost, arrange medical treatment and emergency evacuation services as they deem necessary for my safety. Sailboarding Safaris also reserves the right to cancel any trip for whatsoever reason without penalty or liability on Sailboarding Safaris for doing so. In entering into this agreement, I am not relying on any oral, written or visual representations or statements by the staff or any other inducement or coercion to join the Sailboarding Safari; hence only of my free will.

I confirm that I have read and understood the terms and conditions of this agreement prior to booking and agree that this agreement will be binding upon my heirs, next of kin, executors, administrators and successors.

I agree that this agreement shall be governed in all respects by and interpreted in accordance with the law of New South Wales, Australia.

Payment for your Safari can be via the following payment methods. Credit Card (Mastercard, Visa or Bankcard), Bank Cheque, Personal Cheque or Direct Credit into our accounts. Please note: credit card payments incur a 5% special processing fee added to the gross figure. GST (currently 10%) as prescribed by the Australian Govt is applicable on local Holidays within Australia and must be added to the total package costing on payment. The publicised package costings are GST exclusive. Sailboarding Safaris agent is Jetaway Travel, licence no: 2TA003588. Further, if any damage occurs to Sailboarding Safaris equipment whilst in my care, I acknowledge i am fully responsible up to the full retail value of the equipment used and will be asked to pay for the equipment if damaged.


We regard payment of deposit as agreement and acceptance of these terms and conditions.

BOOKINGS: Booking requests can be made through Sailboarding Safaris or our agent Jetaway Travel, licence no 2TA003588. Bookings are subject to availability of flights, accommodation and transfers at the time of the booking request . All verbal quotes are subject to change until final confirmation of the booking request is made in writing.

DEPOSITS AND BALANCE OF PAYMENTS: A non refundable deposit of $500 per person is required within 7 days of confirmation of booking. Balance of payment is due 60 days prior to departure. If no payment or any notification has been received after 7 days, it will be automatically assumed that the booking is to be cancelled. If the booking is made 60 days or less prior to departure, full payment is required immediately.

CANCELLATIONS AND AMENDMENTS: Should you or any member of your travelling party be forced to cancel, you must notify us in writing. Cancellations more than 60 days prior to departure, will incur a fee of $500.00 per passenger. For cancellations less than 60 days prior to departure, then a minimum cancellation fee of $500 per passenger and up to 100% of the land content will apply. This cancellation will be in addition to any cancellation fee charged by the airline/s or any other carrier.

INSURANCE: It is compulsory that you take out a comprehensive travel insurance policy which will, under certain circumstances and subject to policy conditions, cover such things as cancellation fees, baggage, personal liability and accident and medical cover. It is strongly suggested that insurance be paid with or just after deposit. Please contact Jetaway Travel for this insurance.

TRAVEL DOCUMENTS: All travellers should be aware of any health or visa requirements for the countries that they are travelling to. It is the responsibility of all members of the travelling party to obtain a valid passport and any necessary visas and vaccination document for your holiday. Sailboarding Safaris or Jetaway Travel will not be responsible for any loss or expense due to failure of its clients to obtain any necessary travel documents.

BAGGAGE: There is a 20 Kilogram (44lb) free baggage allowance for economy class air travel. Air Pacific have agreed to a 40kg Baggage Waiver per person, however retain the right to charge at the normal per kilo rate over the amount of 40kg. Payment of any excess baggage charges is the passenger's sole responsibility.

AMENDMENTS TO PRICES AND ITINERARY: Sailboarding Safaris & Jetaway Travel reserves the right to adjust the price of a tour package right up to the date of departure, even though full payment may have been made. This would only be done due to factors which were outside our control and include such things as airfare increases (up to the maximum charged by the airline), increases due to currency fluctuations, hotel price increases or any other increase in services that are part of the tour price. We also reserve the right to amend the itinerary where considered necessary due to any changes that are beyond our control. We will not itemise package prices as the total price includes all tour components , research ,planning and co-ordination. All quoted Fiji prices include a discount of 5% for payment by cheque or direct deposit , payment by credit card will incur an additional 5% charge.

RESPONSIBILITY: We will always try to do our best to make sure that all your travel arrangements are satisfactory, however we do not accept liability for any loss or damage sustained by you as a result of our negligence or that of an employee. sailboarding Safaris & Jetaway Travel does not accept liability for acts, omissions or default, whether negligent or otherwise, of all those providing services in relation to the tour where there is a contract between them and yourselves over which sailboarding Safaris or Jetaway Travel has no direct control, Sailboarding Safaris & Jetaway Travel does not accept liability damages, injury, delay, loss, additional expenses or inconvenience caused directly by events beyond its control, such as, but not limited to, war, fire, flood, acts of God, or acts of Government. It is the responsibility of the passenger to ensure that he/she is in possession of the proper travel documents and that they are in compliance with the current government and transportation companies regulations. No refunds can be made in respect of accommodation and meals not utilised and under no circumstances can refunds be made for tours and sightseeing excursions not undertaken.

LAW OF CONTRACT: Any contracts and any legal action arising are governed in all respects by the law of the State of New South Wales.

AIR TRAVEL: Any Airline who endorse advertising or promotional material associated with Sailboarding Safaris & Jetaway Travel do not by virtue of the said material, represent themselves as either contracting with any person booking a holiday from sailboarding Safaris or as having any other legal relationship with such a purchase. No airline will incur any responsibility or liability to any person booking except for that liability that may be incurred as the carrier.
